Key learning points:
Principle of Proportionality Violated: The use of a thermobaric weapon in a confined structure led to excessive destruction and unnecessary loss of life.
Hors de Combat Violation: Wounded enemy soldiers, who were no longer a threat, were killed in the blast. LOAC prohibits targeting individuals who are hors de combat.
Protection of Medical Personnel: Whether military or civilian, medical personnel are protected under LOAC when engaged in medical duties. They must not be targeted, and attacks causing their death—particularly in protected facilities—constitute serious legal violations.
Protection of Medical Facilities: Hospitals and other medical units are protected objects under LOAC. Destruction of a functioning hospital, unless justified by imperative military necessity and preceded by proper warnings, constitutes a serious breach.
Strategic & Tactical Failure: Destroying a hospital completely negates its potential use—even for the attacking force in the future—and undermines operational legitimacy.
